Agoraph (hereinafter "the Platform") is an online platform enabling Organizers (photographers, brands, image professionals) to create and promote photo workshops (conferences, classes, photo trips, specific workshops such as nude art or lingerie), and Participants to register for them by paying a fee.

Agoraph is not a travel agency and does not offer accommodation, transportation, or insurance services. These aspects fall solely under the Organizer's responsibility.

By using the Platform, you unreservedly accept these Terms and Conditions. If you do not agree, you must not use the Platform.

Definitions

• Organizer : Natural or legal person offering a workshop via the Platform.
• Participant : Natural person registering for a workshop.
• Workshop : Paid or free event organized by an Organizer (classic, photo trip, or specific).
• Photo trip : Workshop including travel with accommodation and/or transportation organized by the Organizer.
• Specific workshop : Workshop involving models (nude/lingerie) or particular conditions (minimum age, enhanced consent).
• Equipment checklist : List of recommended equipment by the Organizer.
• Affiliate link : External link provided by an Organizer. Agoraph receives no remuneration from these links.

Cancellation and Refund Conditions

• Force majeure: Full refund upon justification.
• Agoraph service fees: Non-refundable in case of cancellation.

Booking and Payment

• Payment only via Stripe (secure, PCI DSS compliant).
• Confirmation by email with workshop details, total amount (price + Agoraph fees), and link to Terms and Conditions.
• For photo trips: Payment possible in installments (deposit + balance), terms indicated by the Organizer.

Image Rights and Consent

Classic Workshops

Consent via checkbox during booking: "I accept that my image may be captured during the workshop and used by the Organizer for promotional purposes."

Specific Workshops (nude/lingerie)

Minimum age: 18 years (verification possible via ID).

Mandatory Written Consent

Form to be signed before the workshop, including:

• Purpose of image use.
• Retention period.
• Right of withdrawal.

Proof to be kept by the Organizer.

Prohibition of distribution without written agreement from the Organizer and models.

Use by Agoraph

• Agoraph may use generic photos (atmosphere, equipment) to promote the Platform, with Organizer's agreement.
• No Participant photos will be used without explicit consent.

Reviews and Ratings

• Participants are invited to leave a review after the workshop.
• Objective and respectful reviews (moderation possible in case of abuse).
• Prohibition of fake reviews or incentive reviews.

Responsibilities

Agoraph

Is not a travel agency: Not responsible for transport/accommodation issues.

Does not guarantee

• The quality or legality of workshops.
• The actual execution of workshops.
• Participant safety.

Disclaims all responsibility in case of

• Material or bodily damage.
• Dispute between Organizer and Participant (except voluntary mediation).
• Loss/theft of equipment.

Organizers

Responsible for:

• Safety and proper conduct of the workshop.
• Compliance with laws (image rights, minors protection).
• Damages caused to Participants or third parties.
• For photo trips: Logistics and insurance validity.
• For specific workshops: Age verification and obtaining consents.

Participants

Agree to:

• Respect workshop rules.
• Verify their eligibility (age, equipment).
• Take out personal insurance if necessary.

Disputes and Applicable Law

• Amicable resolution as a priority.
• Courts of [Agoraph headquarters city] are competent.
• Applicable law: French law.

Modifications of Terms and Conditions

• Agoraph may modify the Terms and Conditions at any time.
• Notification by email in case of major changes.
• Continued use = acceptance of new Terms and Conditions.
